Description
The book examines the constituents of adjectival laws which chart the course at trial in civil litigation, the vital issues of whether evidence sought to be tendered meets legal requirements for admissibility, issues relating to order of attendance and examination of witnesses which are crucial aspects of proceedings at trial and categories of irregularities that may occur in civil proceedings. Also, the book examines the various canon of interpretation of statutes, the Constitution and terms in a document presented at trial in the course of civil litigation. Moreover, specific subjects including the undefended list procedure, summary judgement procedure and proceedings in lieu of demurrer were discussed in the book. Legal precedents are provided where necessary to graphically explain procedures. The acid test of whether any judicial proceedings followed due process, in order to keep the streams of justice pure, is whether the constitutionally guaranteed right of fair hearing was observed during the proceedings, therefore, examination of the right of fair hearing was apportioned a full chapter in the book. It is our hope that lawyers in litigation practice, judges and other stakeholders in justice delivery will find the book immensely useful. All errors in the book are mine.
